Rescode

ResCode is a common term used to describe the siting provisions of Part 4 of the Building Regulations. An application to vary a Part 4 Regulation may be submitted to Council.

Three common applications are:

1. Building over an easement

When a building is proposed to be built over an easement consent is required from the responsible authorities. An application form must be forwarded to Council's Building team for approval.

2. Vacant Land

When an outbuilding is proposed to be built on a lot which does not have a dwelling located on the land. Consent is required from Council.

3. Rescode (Siting and Fencing)

Often proposals cannot fit in the required building envelopes for various reasons. Where this situation arises, the Building Regulations allow the Municipal Building Surveyor to make a decision with respect to non-compliance issues.

A decision is reached after consulting with various affected parties. Your application may be refused or accepted, and a decision is usually made within 30 working days of receipt of your application.

There are several requirements for fences:

  1. Fences within 9 metres of an intersection greater than 1 metre in height are required to have special consent from the Municipal Building Surveyor.
  2. Front fences over 1.5 metres in height for a non-declared road and 2 metres for a declared road.
  3. Side boundary fences over 2 metres in height.

Applications are generally referred to a Traffic Engineer for comment and advice prior to the Municipal Building Surveyor making a decision.
